Liverpool Independent Art School (LIAS)

1/ Contract

1.1/ The terms of LIAS’s price list and these terms and conditions constitute the terms of the legally binding contract (“the Contract”) between you, the student and Liverpool Independent Art School (“LIAS”).

1.2/ Any enrolment application by you will be subject to written acceptance by LIAS.

1.3/ Our courses are aimed at adults. However we occasionally welcome 16 and 17 year olds when accompanied by a parent/guardian. The accompanying parent/guardian must also enrol on the course, workshop or class session.

1.4/ ‘Courses’ refers to all our delivery, both our face to face and online delivery and includes but is not limited to our short courses, workshops half day and full day, life drawing and longer programmes.

2/ Course

2.1/ You must attend all courses on a punctual basis unless prevented by events which are beyond your reasonable control.

2.2/ You must comply with all rules and regulations issued by LIAS from time to time.

2.3/ LIAS will be entitled to change the timing and/or content of any course and to substitute any teacher at any time.

3/ Fees

3.1/ Enrolment on courses is subject to payment either of a deposit or full fees as set out in LIAS’s price list. Deposits are non-refundable.

3.2/ Following acceptance by LIAS of your application, you will be contractually bound to pay the full amount of the fees. No refund will be made if you subsequently fail to attend all or any part of the course (and LIAS is unable to reallocate your place).

3.3/ All fees must be paid not less than 2 weeks before the start of the course, subject as set out below.

3.4/ If LIAS has agreed that fees may be paid by instalments, each instalment must be paid by the instalment date set out by LIAS. Any deposit paid will be deducted from the final instalment. The obligation to pay each of the instalments will continue notwithstanding that you subsequently fail to attend all or any part of the course. Failure to pay any instalment by the due date or attend the course will result in the balance of the fees becoming immediately payable.

3.5/ If fees are not paid by the due date, LIAS will be entitled to reallocate your place (without prejudice to the obligation to pay the fees).

3.6/ Any deposit and/or fees paid will only be returned if LIAS is unable to offer you a place on your chosen course.

4/ Your Conduct

4.1/ Abusive or inappropriate language; threatening, bullying, disruptive or inappropriate behaviour towards staff or other students will result in you being removed from the course and/or your membership being revoked.

The course fee will not be reimbursed in this event. We reserve the right not to accept a student on future courses.

5/ Termination

5.1/ You may only terminate the contract in the circumstances set out below.

5.2/ You may only terminate the contract if you give LIAS written notice of termination and the LIAS receives such notice not less than 2 weeks before the start of the course. Provided that LIAS has received your notice of termination prior to the deadline, LIAS will refund any fees paid but will retain an administration fee of 50% of the deposit paid. You must receive confirmation in writing that LIAS has agreed to terminate the contract in order to be eligible for a refund. The confirmation should be obtained for your records.

5.3/ For online courses and webinars, LIAS reserves the right to retain the full payment amount in case of termination.

5.4/ LIAS will be entitled to cancel any course at any time subject to the repayment of any fees received in respect of the course or the part of the course which has been cancelled. LIAS does not accept any liability for any costs or loss that may be incurred.

5.5/ FORCE MAJEUR Refunds do not apply when your course is cancelled as a result of risk of war or threat of war, riot, civil strife, industrial dispute, terrorist activity, natural disaster, fire or adverse weather conditions and similar events beyond our control. In those circumstances travel insurance should apply.

6/ Liability

6.1/ You must not bring any items of special value to LIAS’s courses or premises. LIAS will not accept responsibility for the loss of any personal possessions.

6.2/ LIAS will not be liable for any loss suffered by you which is indirect, special or consequential.

6.3/ LIAS will not be liable for any loss suffered by you resulting from any event which is beyond the reasonable control of LIAS.

7/ General

7.1/ The contract contains all of the contractual terms agreed between you, the invoice addressee and LIAS.

7.2/ No failure or delay by LIAS in enforcing any of its rights under the contract shall be deemed to be a waiver of such right.

7.3/ The contract shall be governed by English law.

7.4/ Students are strictly forbidden to use cameras or use camera functions on mobile devices in the studio whilst there is a model present. If this condition is breached you will be required to allow staff to erase all images from the device.

8/ How we use your data

8.1/ We will only retain details for as long as they are useful for LIAS.

8.2/ All inactive records will be deleted after five years.

8.3/ After five years we will retain booking history but this will not be attached to any personal details.

8.4/ No credit or debit card information will be held by LIAS

8.5/ We will not sell your data to any third parties.

9/ Website and Copyright

9.1/ No part of LIAS’s website, its services or its content may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission. 

9.2/ Copyright of all course content whether studio based or online, is retained by the artist or LIAS and you must not share access to this content with anyone.

All information, including but not limited to, lesson plans, videos, structures and handouts are for your sole use and are not to be shared or used in any form without the written agreement from LIAS.

You must not share any image, phrase, lesson or title to promote yourself.

NOTE

If possible you are advised to take out insurance against loss of fees through illness or personal accident.
